Agreement
These Terms govern your use of the Nod iOS application (listed on the App Store as "Just Nod") and the website at usenod.app (together, the "Service"), published by Speculative Dynamics Private Limited, a company incorporated in India ("Speculative Dynamics", "we", "us").
By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, please don't use the Service.
Licence
The source code of Nod is released under the MIT License, available at github.com/Speculative-Dynamics/nod/blob/main/LICENSE. You are free to read, modify, redistribute, and build the app from source under those terms.
The binary distributed through the App Store, the Nod name, the "Just Nod" name, and the associated artwork and marks on this website are provided to you under a personal, non-exclusive, non-transferable licence for your use of the Service as provided.
What Nod is and isn't
Nod is a small on-device AI that listens to what you write and responds in the tone of a careful friend. It is a consumer wellness and self-reflection tool.
Nod is not a medical device, a therapist, or a crisis service. It does not diagnose, treat, or provide professional mental-health advice. If you are in crisis or need support from a qualified human, please contact a local emergency service, a trained counsellor, or a dedicated helpline.
India-based users in distress can contact iCALL (+91 9152987821) or Vandrevala Foundation (1860-2662-345). Outside India, please use a local crisis line.
Your responsibilities
- You must be at least 13 years old (or the minimum age in your jurisdiction) to use Nod.
- You are responsible for the device you run Nod on, including keeping it updated and secured.
- You will not attempt to misuse the Service — for example, by reverse-engineering the App Store binary to redistribute it under a different name, or by using automated means to scrape the website in a way that degrades it for others.
- You understand that the content you write in the app stays on your device (see our Privacy Policy). Deleting the app or using "Start fresh" is irreversible.
On-device AI output
Nod's responses are generated by a language model running on your device. Model output can be incorrect, incomplete, or surprising. Do not rely on Nod's responses for medical, legal, financial, safety-critical, or other consequential decisions. Use your own judgement.
Availability, changes, and end of service
We provide the Service "as is" and may update, modify, or discontinue any part of it at any time. We may change these Terms; when we do, we'll update the "Last updated" date above and, for significant changes, note it in the app's release notes and on the website homepage.
No warranty
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.
Limitation of liability
To the maximum extent permitted by law, Speculative Dynamics Private Limited and its contributors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. Our aggregate liability for any direct damages arising from the Service shall not exceed INR 1,000 (one thousand Indian rupees) or the amount you have paid us in the preceding twelve months for the Service, whichever is greater. Nod is free, so in practice this cap is INR 1,000.
Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms, including their validity, interpretation, or termination, shall be subject to the exclusive jurisdiction of the courts in India.
App Store terms
If you obtained Nod from the Apple App Store, Apple's own standard end-user licence agreement also applies to your use of the app. In case of conflict with these Terms, Apple's agreement prevails only in respect of the app-distribution relationship between you and Apple.
